Terms & Conditions of Use

You may use Pech Pechoo only if you:

• Are at least 13 years old (parent/guardian consent required for minors);

• Reside in Australia (for the MVP period);

• Accept these Terms.

We may refuse Platform access at our discretion.

Pech Pechoo does not sell tickets, collect payments, or act as an agent for organisers or venues.

• Ticket sales are handled by third-party ticket providers.

• All purchases, refunds, exchanges, cancellations, and disputes are between you and the ticket provider.

• We are not responsible for ticket availability, pricing, accuracy, or order fulfilment.

A disclaimer will appear on all event pages.

Pech Pechoo displays event information that may come from:

• Event organisers; or

• Publicly available sources (self-posted by Pech Pechoo).

When we collect event information manually from public sources:

• We copy factual details only (date, time, venue, ticket URL).

• We paraphrase descriptions to avoid copying creative text.

• We provide attribution where reasonable.

We do not guarantee the accuracy, completeness, or currency of event information.

You should always confirm details on the organiser or ticket provider website.

Pech Pechoo aims to provide a comprehensive directory of Persian and other relevant events across Australia. We do not guarantee that every event will be listed or that event information will always be complete, current or accurate. Users should confirm important event details with the organiser or official ticket provider before attending or purchasing tickets.

Organisers may request to:

• Claim an event listing;

• Update or correct event details;

• Upload images or descriptions;

• Request removal.

When claiming an event, organisers:

• Warrant they are authorised to act on behalf of the event and/or artist;

• Grant Pech Pechoo a licence to display event details and media;

• Warrant that uploaded content does not infringe copyright or other rights;

• Agree to keep information accurate and updated;

• Indemnify Pech Pechoo for claims arising from organiser-supplied content.

We may suspend, hide, or remove listings at our discretion.

When creating an account, you must provide accurate information.

We may create a "shell account" when you submit a review verified by SMS, after which you may optionally activate a full account.

We may suspend or terminate accounts that:

• Violate these Terms;

• Post harmful or unlawful content;

• Attempt to manipulate ratings or reviews.

Users may submit reviews based on their first-hand personal experience at an event.

By submitting a review, you confirm that:

• The review is based on your own experience;

• It is your genuine opinion;

• You received no incentive or compensation to write it;

• It is truthful to the best of your knowledge;

• It follows our Community Guidelines.

You agree that:

• Reviews may be moderated (edited, hidden, or removed) before or after publication;

• Reviews must not include second-hand information, rumours, or unverified allegations;

• Reviews must not contain defamation, hate speech, personal insults, discrimination, or threats;

• You must not accuse artists, organisers, or venues of wrongdoing, fraud, or criminal behaviour unless you possess verifiable evidence;

• You must not post photos or personal information of others without consent.

We may contact you for verification, including to confirm attendance or identity.

When submitting content (reviews, ratings, images, feedback), you grant Pech Pechoo a:

• Non-exclusive,

• Worldwide,

• Royalty-free,

• Transferable,

• Perpetual licence

to host, store, reproduce, display, distribute, publish, and otherwise use the content on the Platform.

You must not:

• Post content that is defamatory, misleading, false, or unlawful;

• Impersonate another person;

• Attempt to manipulate reviews, ratings, or event popularity;

• Post paid or incentivised reviews;

• Attempt to damage competitors or rival organisers;

• Threaten organisers or artists with review blackmail;

• Scrape, copy, or reverse-engineer our Platform;

• Bypass moderation systems.

Violations may result in account suspension, content removal, legal action, or a permanent ban.

Pech Pechoo may:

• Review content before publication;

• Hide, edit, or delete content;

• Respond to legal complaints;

• Temporarily suspend reviews for an event experiencing unusual or suspicious activity.

We may remove content without providing a reason.

Users may report reviews, content, or users that they believe violate these Terms or our Community Guidelines. We may investigate reports and restrict accounts, remove content, or take other appropriate action.

If you believe content on the Platform is unlawful, defamatory, or infringes your rights, you may request removal via our formal process.

We will:

• Acknowledge your complaint within 48 hours;

• Temporarily hide content where appropriate;

• Investigate and request additional evidence from either party if needed;

• Make a final moderation decision.

We are not obligated to restore removed content.

All trademarks, graphics, logos, and platform design elements belong to Pech Pechoo.

Event media uploaded by organisers remain their property.

Users and organisers must not upload copyrighted material unless authorised.

Organisers or third-party advertisers may purchase advertising or promotional placement.

Advertisers must ensure:

• Content complies with Australian Consumer Law and Ad Standards;

• All claims are accurate and substantiated;

• No unlawful or harmful content is included.

We may decline advertising related to age-restricted or regulated categories (e.g., gambling, alcohol).

Sponsored listings will be clearly marked.

Pech Pechoo does not guarantee:

• Uninterrupted service;

• Error-free operation;

• Secure data transmission.

We may update, modify, or suspend parts of the Platform without notice.

To the extent permitted by law:

• Pech Pechoo is not liable for any loss, injury, damages, or expenses arising from event attendance, ticket purchases, event cancellations, venue conditions, or organiser actions;

• Pech Pechoo is not responsible for user-generated content (including reviews);

• Pech Pechoo does not guarantee the accuracy of event information.

Where liability cannot be excluded, it is limited to the maximum extent permitted by Australian law.

You agree to indemnify and hold harmless Pech Pechoo, its directors, staff, and contractors from:

• Claims arising from your content;

• Your breach of these Terms;

• Disputes with event organisers, venues, or ticket providers;

• Any legal claim involving your reviews or actions on the Platform.

Our Privacy Policy explains how we collect, store, and use personal data, including SMS verification data.

By using the Platform, you consent to the practices described in the Privacy Policy.

We may terminate or restrict access to the Platform at our discretion, without notice, including when users:

• Violate these Terms;

• Manipulate reviews;

• Attempt fraud or harassment;

• Post harmful or illegal content.

Users may delete their account at any time. When an account is deleted, Pech Pechoo will delete or de-identify personal information and user-generated content associated with the account, including reviews, except where information must be retained for legal, fraud prevention, dispute resolution, moderation, or regulatory purposes.

We may update these Terms periodically.

Continued use of the Platform constitutes acceptance of the updated Terms.

These Terms are governed by the laws of Victoria, Australia.

Any disputes must be resolved in Victorian courts.
